What type of information will PLFEE need to evaluate the case?
PLFEE may request additional information after reviewing your application. The additional information may include such things as the police report (if your case involves a motor vehicle accident), witnesses statements, a copy of the emergency room record, a copy of the discharge summary for any in patient hospitalizations, a recent narrative report from your treating doctor, an expert's report if your case involves medical malpractice, a copy of the Complaint, if one has been filed by your lawyer, etc.

Will PLFEE do a credit check?
No. No credit check is ever made with regard to your credit.

Who is eligible to get an advance from PLFEE?
Anyone with a viable lawsuit and who has an attorney may be eligible.

Is there any minimum or maximum amount PLFEE will advance?
PLFEE advances cash in amounts ranging from $1,000.00 to $25.000.00.

How does PLFEE determine how much it will advance?
PLFEE looks at many things in determining how much to advance, including, but not limited to, the liability aspect of the case (that is how good a case you have), the nature of the injuries and how serious they are, whether there is any residual injury, the amount of your medical bills, the amount of your lost wages, where the case is or will be filed, the identity of your lawyer and of the lawyer representing the defendant(s), how long we anticipate the advance will be outstanding, etc.

Yes. The services of PLFEE are not available in all states. Please call our toll free number, 1.866.379.9590, to find out if PLFEE services your state.

Are there any types of cases in which PLFEE does not provide advance funding?
Yes. PLFEE does not provide advance funding in workers' compensation cases unless, along with the workers' compensation case, you have a third party claim, i. e. a claim against some third party who may have caused your injury; a third party being someone other than your employer or a fellow employee. Also A C S F does not provide advance funding in cases where the injury is to a minor (child) unless the parent(s) of that child have a viable claim in their own right, i.e., for loss of services, emotional distress, or for providing services to the child.

Must be lawsuit be filled in order for me to get an advance?
Yes, your attorney must have filed a lawsuit on your behalf in order for you to be eglible.

What is the legal mechanism by which PLFEE is able to provide advance funding?
PLFEE provides advance funding by purchasing, from you, a lien against the proceeds of your case. Therefore, if you get nothing as a result of your claim or case you will owe PLFEE nothing and the money advanced is FREE.

Will I have to sign any documents?
Yes. You will sign a Lien Purchase Agreement (view sample Agreement in PDF or view in WORD) in which you agree to have your lawyer repay the agreed amount, from the proceeds of your case, upon the successful conclusion of the case.

Will my lawyer be required to sign any documents?
Yes. However, by signing your attorney is ONLY agreeing to provide PLFEE with requested information about your case AND to pay PLFEE from his/her trust account using the proceeds of your case. Your attorney makes NO representations as to the viability of your case and/or whether you will get any money.

Do I have to make monthly payments?
No. There are no monthly payments. PLFEE gets paid only at the end of your case from the proceeds of your case, when the case is successfully concluded.

Are there any up front fees?
No. There are no up front fees. The only money you will ever pay is from the proceeds of the case at the conclusion of the case.

What if I loose my case and get no money, will I still have to repay PLFEE?
No. If you lose and get no money, the money PLFEE advanced to you is a gift to you and is FREE.

Does PLFEE become involved in my case if I get an advance?
No. PLFEE does not participate in ANY way in your law suit, including, but not limited to, the preparation of the case, the trying of the case or its settlement.

Will PLFEE get paid before my lawyer?
No. PLFEE only gets paid AFTER your lawyer is paid his/her fee and costs and AFTER any superior liens, e.g., medical bills, are paid.

Can I get more than one advance on my case from PLFEE?
Maybe. In order for PLFEE to consider making for more than one advance, something significant must have happened with regard to your case, since the last advance, i.e., a favorable deposition having been taken, an offer to settle having been made, etc.

And the MOST IMPORTANT QUESTION--How much will it cost upon the successful conclusion of my case?
While it is impossible to tell you in advance just what it will cost, we can tell you that:

  • If you do not get any money, it will cost you NOTHING.
  • That the money is expensive.
  • That PLFEE is competitive with the rest of the industry and generally more than competitive (i.e., your cost is lower with PLFEE).
  • The cost typically ranges between 3.75% to 5% per month, compounded monthly, of the amount advanced, payable at the end of the case from the proceeds of the case.
(N.B These percentages apply only when the advance is founded in house and may not apply to founding by an affiliate company.)
Is there a cap, that is a limit on the amount I will owe from the proceeds of my case?
PLFEE will consider putting a cap (limit) on the amount that you will owe. Again each case is considered on an individual basis.
